These Terms of Service ("Terms") govern your access to and use of Smartfish Hub (the "Service"), operated by SmartFish ("SmartFish," "we," "us"). By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Smartfish Hub lets you build a page ("Hub Page") to publish links, sell products and digital downloads, take paid bookings, run subscriptions, capture leads, and manage a built-in CRM. Some features depend on you connecting your own Stripe account and are only available once that connection is active.
2. Accounts
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an account. You are responsible for the accuracy of the information you provide and for all activity under your account, including keeping your password confidential. Tell us right away if you suspect unauthorized access.
3. Trials, Billing & Cancellation
Paid plans start with a 7-day free trial. A payment card is required to start a trial; you will not be charged until the trial ends. Unless you cancel before the trial ends, your subscription automatically converts to a paid plan and is billed on a recurring basis at the price shown for your selected tier at the time of purchase.
You can upgrade, downgrade, or cancel at any time from your account billing page. Cancellation stops future billing but does not refund amounts already charged for the current billing period, except where required by law. Subscription payments are processed by Stripe; we do not store your full card details.
4. Payments You Collect From Your Customers
When you sell products, bookings, subscriptions, or locked content through your Hub Page, payment is processed through your own connected Stripe account. Funds from those sales go directly to your bank account through Stripe - SmartFish is not a party to that transaction, does not hold or take a cut of those funds, and is not responsible for delivering the products or services you sell. You are solely responsible for fulfilling orders, honoring your own refund policy, complying with tax obligations, and complying with Stripe's own terms of service.
5. Your Content
You own the content you upload or create on your Hub Page ("Your Content"). You grant SmartFish a non-exclusive, worldwide license to host, store, display, and transmit Your Content solely to operate and provide the Service. You are responsible for having the rights to everything you upload, and for the accuracy and legality of Your Content.
6. Acceptable Use
You agree not to use the Service to:
- Break any applicable law, or infringe anyone's intellectual property, privacy, or other rights;
- Sell or promote illegal goods or services, or engage in fraud, phishing, or deceptive commercial practices;
- Distribute malware, spam, or attempt to disrupt, overload, or gain unauthorized access to the Service or other users' data;
- Impersonate any person or entity, or misrepresent your affiliation with one; or
- Collect personal data from visitors to your Hub Page without a lawful basis and a way for them to understand how their data is used.
We may remove content or suspend accounts that violate this section.
7. Custom Domains
On eligible plans, you may point a domain you own at your Hub Page. You are responsible for your domain registration and DNS configuration. SSL certificates are issued automatically once your domain's DNS is verified as pointing to the Service.
8. Our Intellectual Property
The Service itself - including its software, design, templates, and branding - is owned by SmartFish and protected by intellectual property law. These Terms do not grant you any right to use the SmartFish name or branding except as needed to identify that your page was built with the Service.
9. Suspension & Termination
We may suspend or terminate your access if you materially breach these Terms, if your subscription lapses, or if required by law. If your plan expires or a payment fails, your Hub Page Builder remains accessible but your public page may go offline until the subscription is restored. You may stop using the Service and delete your account at any time.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SMARTFISH WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE.
12. Indemnification
You agree to defend and indemnify SmartFish against claims, damages, and expenses arising from Your Content, your use of the Service, or your violation of these Terms or of any law.
13. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will update the effective date above and, where appropriate, notify you by email. Continuing to use the Service after changes take effect means you accept the updated Terms.
14. Governing Law
These Terms are governed by the laws of the State of Israel, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or the Service will be subject to the exclusive jurisdiction of the competent courts of Israel.
